Copyright and DMCA Notices

Players can post some of their own content in FoundFilm: profile pictures, profile backgrounds, bios, comments, Dark Room names and notes, and trade messages. If you believe something a player posted infringes your copyright, send a notice to our designated agent below. We review every valid notice and remove infringing material quickly.

What a notice needs

Under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), your notice has to include:

  1. Your physical or electronic signature. Typing your full name at the end of an email counts.
  2. The copyrighted work you believe was infringed.
  3. Where the material is in FoundFilm, specific enough for us to find it: the player's username and what it is (for example, their profile picture or a comment on a print). A screenshot helps.
  4. Your name, mailing address, phone number and email.
  5. A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.

Notices missing these parts may not be acted on. Sending a notice that knowingly misrepresents infringement can make you liable for damages.

If your content was removed

If you believe something of yours was removed by mistake or misidentification, you can send a counter-notice to the same agent. It needs:

  1. Your physical or electronic signature.
  2. What was removed and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good faith belief it was removed by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice.

Repeat infringers

In appropriate circumstances, we disable the accounts of players who repeatedly infringe other people's copyrights. Putting removed material back up is the clearest example. Each case is looked at on its own.
