FoundFilm Terms of Service
These Terms of Service ("Terms") are a contract between you and Reid Operating Systems Inc. ("we," "us," "our") governing your use of the FoundFilm mobile application ("FoundFilm," the "App"). By downloading or using FoundFilm, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use FoundFilm. At account creation you confirm that you are 13 or older; if you are under 13 you may not use the App. If you are between 13 and the age of majority where you live, you confirm that a parent or guardian has reviewed and agreed to these Terms. If you are a parent or guardian who permits a minor to use FoundFilm, you agree to these Terms on the minor's behalf and you are responsible for the minor's use of the App, including any purchases made through the minor's account.
2. Your account
You are responsible for your account and for keeping it secure. Provide accurate information, keep one account per person unless we allow otherwise, and do not share your account. You are responsible for activity that happens under your account.
3. Licence to use FoundFilm
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use FoundFilm for your own non-commercial entertainment, subject to these Terms. You may use FoundFilm on any compatible device that you own or control. Where you download FoundFilm from an app marketplace, your use is also subject to that marketplace's applicable terms – including, for the Apple App Store, the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing where enabled), and for Google Play, the Google Play Terms of Service. We reserve all rights not expressly granted.
4. Acceptable use
You agree not to: break the law or these Terms; cheat, use bots, spoof your GPS location, or otherwise gain an unfair advantage; buy, sell, rent, or trade any account, virtual item, or in-app currency for real money or anything of value outside the App; harass, threaten, or harm other players; post content that is illegal, hateful, harassing, sexually explicit, or infringing; impersonate others; attempt to access, disrupt, or reverse-engineer the App or its systems; or exploit bugs. We may remove content and suspend or terminate accounts that break these rules.
5. Your content
You may post content such as usernames, bios, comments, collection names, trade messages, profile pictures, and profile backgrounds (“User Content”). You keep ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, adapt, display, and use it to operate and promote the App. To the extent permitted by law, you waive your moral rights in your User Content in our favour for these purposes. You are responsible for your User Content and confirm you have the right to post it. We may review, remove, or refuse any User Content, and we provide in-app tools to report and block other users. We are not responsible for User Content posted by others.
6. Player-to-player trading
FoundFilm lets players trade collectible "prints" and in-app currency with each other. Trades are between players. We provide the platform but are not a party to and do not guarantee any trade. Trade carefully; completed trades are generally final. We may reverse, cancel, or void trades and take action on accounts involved in fraud, scams, exploits, or other abuse. We are not liable for losses arising from trades between players.
7. Virtual items and in-app currency
FoundFilm includes virtual items ("prints" and editions) and in-app currency ("movie tickets"). These are licensed to you for use in the App only. They have no real-world monetary value, are not your property, cannot be redeemed for real money, and cannot be transferred, sold, or cashed out outside the App. You have no ownership interest in them. We may manage, regulate, change, or remove virtual items and currency, and they have no value if your account is closed or the App is discontinued, except where the law requires otherwise. All purchases of virtual items and currency are final except where a refund is required by the policies of the app store you purchased through or applicable law.
Inactive accounts. If you do not use your account for 60 days, any 70MM prints in it may be released back into the game. Your other prints and your account are not affected.
Rewarded ads. FoundFilm uses optional ads that you can choose to watch for an in-game reward. We do not show ads you did not choose to watch. Rewards from ads are in-game items only.
Events, Premieres and Giveaways. From time to time we run free events, such as Premieres, streak events and gifts. No purchase is necessary to take part. Each event’s rules are shown in the App. Prizes are in-game items only, have no cash value, and cannot be exchanged for money. Our staff and test accounts cannot win. We may change, cancel or end an event at any time, and we may withhold a prize from an account that cheats or breaks these Terms.
8. Purchases, subscriptions, and in-app purchase
All purchases in FoundFilm, including movie tickets, subscriptions, and any premium features, are made through the in-app purchase system of the app store you downloaded FoundFilm from (such as the Apple App Store or Google Play). We do not offer other ways to buy or unlock these items.
Subscriptions. FoundFilm offers optional weekly, monthly, and yearly subscriptions. If an offer includes a free trial, your paid subscription starts automatically when the trial ends and your app store account is charged, unless you cancel at least 24 hours before the trial ends. Before you subscribe, the App describes what you get for the price. Paid subscriptions renew automatically at the end of each period and continue until you cancel. Your app store account is charged for the renewal at the then-current price at the start of each period. You can manage or cancel your subscription in your app store account settings (Apple ID subscription settings or Google Play subscription settings); cancellation takes effect at the end of the current period. Refunds are handled by the app store you purchased through, under its policies.
Refunds. If a purchase is refunded, we may remove the movie tickets or items it provided, even if this makes your balance negative. While your balance is negative you cannot spend movie tickets. We may suspend or ban accounts that repeatedly request refunds for purchases they have used.
Special offers and referrals. We may offer limited-time prices, sales, founding-player offers and referral rewards. Each offer shows who qualifies and when it ends. Offers can change or end at any time, and we may refuse or reverse a reward earned through fake accounts, cheating or abuse.
9. Developing prints
FoundFilm lets you develop collectible prints by walking in the real world or by using in-app currency (“movie tickets”). When you develop a print, you choose a rarity tier and receive a film within that tier. Prints are virtual items licensed under Section 7 (Virtual items and in-app currency). They have no cash value, cannot be redeemed for real money, and cannot be sold or exchanged outside the App, and we do not offer any means to cash them out.
10. Third-party services
Apple. Where you use FoundFilm on iOS, purchases and sign in with Apple are provided by Apple under Apple's terms.
Apple Music (MusicKit). FoundFilm lets you add a song to your profile using Apple Music. This feature uses Apple MusicKit and is subject to Apple Music’s terms. Your use of Apple Music content is governed by Apple.
Capgo. Delivers live app updates, and handles purchases through Apple’s StoreKit.
Google. Where you use FoundFilm on Android, purchases and Google Sign-In are provided by Google under Google's terms.
Google Fonts. Provides the app’s font.
Supabase. Our database and player accounts.
Cloudflare. Our servers and hosting.
Sentry. Crash and error reporting.
TMDB. FoundFilm uses movie data and images from The Movie Database. This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.
Maps. The in-app map is drawn from tiles served by our own servers, not Google Maps, Apple Maps, or another map-service provider.
Google AdMob. FoundFilm uses optional ads that you can choose to watch for an in-game reward. We do not show ads you did not choose to watch. Rewards from ads are in-game items only.
FoundFilm may also contain links to third-party websites or services that we do not control. We are not responsible for their content or practices, and your use of them is at your own risk.
11. Intellectual property and copyright
FoundFilm, its design, code, and branding are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works except as allowed by these Terms. Movie titles and posters belong to their respective owners and are provided through TMDB.
If you believe content in the App infringes your copyright, send a notice to legal@foundfilm.app that includes: your contact information; identification of the copyrighted work; identification of the infringing material and where it appears in the App; a statement that you have a good-faith belief the use is not authorized; a statement, made under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act for the owner; and your physical or electronic signature. We will remove or disable access to infringing material, and in appropriate cases we will terminate the accounts of users who repeatedly infringe. Our designated agent is registered with the US Copyright Office (DMCA-1081902).
If you send us suggestions, ideas, or other feedback about the App, you grant us the right to use that feedback without restriction and without compensation to you.
12. Termination
You may stop using FoundFilm and delete your account at any time in Settings. We may suspend or terminate your access if you break these Terms or to protect the App and its players. Some provisions survive termination, including Sections 5 (Your content), 7 (Virtual items and in-app currency), 13 (Disclaimers), 14 (Limitation of liability), 15 (Indemnification), and 16 (Dispute resolution and governing law).
Bans and usernames. If we suspend or ban an account, usernames it has used may stay unavailable to other players. A suspended or banned account cannot be deleted from inside the App; contact us at support@foundfilm.app and we will handle the deletion.
13. Disclaimers
FoundFilm is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure, or that items or trades will always be available. FoundFilm is a walk-to-collect game played in the real world. Always stay aware of your surroundings, obey all laws, and do not trespass on private property or enter unsafe areas while playing. You play at your own risk.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or virtual items. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the 12 months before the claim or fifty US dollars (US$50.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold us harmless from claims and expenses arising out of your use of the App, your User Content, your trades, or your breach of these Terms, to the extent permitted by law.
16. Dispute resolution and governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws rules. Nothing in these Terms limits rights you have under mandatory consumer-protection laws where you live. Before starting a formal proceeding, you agree to first contact us at info@foundfilm.app and give us 30 days to try to resolve the dispute with you informally. Subject to those consumer-protection laws, any dispute arising out of or relating to these Terms or the App must be brought in the courts of the Province of Ontario, and you and we each submit to the jurisdiction of those courts. You may also bring a claim in a small claims court that has jurisdiction over it.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version in the App with a new "Last updated" date and, for material changes, provide additional notice where required. Continued use after changes means you accept them.
18. Apple-specific terms (End User License Agreement)
If you downloaded FoundFilm from the Apple App Store, the following apply:
- These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
- Your licence to use FoundFilm is a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We, not Apple, are solely responsible for the App and for providing any maintenance and support for it. Apple has no obligation to furnish support.
- To the extent any warranty applies and the App fails to conform, you may notify Apple and Apple may refund the purchase price; otherwise, to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or privacy law.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the App infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not on any U.S. Government restricted-parties list.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Questions, complaints, or claims about the App should be directed to us at legal@foundfilm.app.
19. Google Play Terms
If you downloaded FoundFilm from Google Play, you acknowledge that these Terms are between you and us only, not with Google; that Google is not responsible for the App or these Terms; and that your use of the App is also subject to the Google Play Terms of Service.
20. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App and replace all prior discussions and understandings. If any provision of these Terms is found to be unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions remain in full force. If we do not enforce a provision, we do not waive our right to enforce it later. You may not assign these Terms. We may assign these Terms, including in connection with a merger, acquisition, financing, or sale of all or substantially all of our assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. You agree that we may provide notices and other communications relating to the App electronically, in the App or by email, and that electronic communications satisfy any legal requirement that a communication be in writing.
